Ruben Studdard is suing the company whose shirts he wore during many of the early episodes of American Idol 2. The suit, part of which is reproduced on The Smoking Gun, accuses the company of “commercial misappropriation” for “their unauthorized use of Studdard’s name and likeness” and “efforts to unfairly and unlawfully exploit and capitalize on Studdard’s immense popularity and fame,” including on its web site. Although 205 Flava’s web site is currently offline, the web site’s description in Google’s search listing says, “As seen on the New American Idol Ruben Studdard.” Ruben wants some of the $2 million in profits he says the company has earned as a result.
